By accessing our website, booking an appointment, visiting our clinic, communicating via WhatsApp, or using any of our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services. INTERPRETATION AND DEFINITIONS For the purposes of this Agreement: "Services" means all physiotherapy treatments, consultations, assessments, exercises, guidance, and support provided by Healing Health Physiotherapy. "Patient" means any individual who uses our services or books an appointment with us. "Clinic" refers to our physical location at 677, Royal School के पास, Durga Colony, Sanjeevani Nagar, Garha, Jabalpur, Madhya Pradesh 482003, India. "Platform" includes our website, WhatsApp channel, phone line, and any other communication medium we use. "Appointment" refers to a scheduled physiotherapy session or consultation with our team. ACCEPTANCE OF TERMS By using Healing Health Physiotherapy's services, you acknowledge that you have read, understood, and agree to be bound by this entire Terms and Conditions document. You confirm that you have the legal capacity to enter into this agreement and that you are not prohibited by any law from using our services. If you are under 18 years of age, you must have your parent or legal guardian's consent to use our services. Your use of our services constitutes your acceptance of these terms. We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after modifications indicates your acceptance of the updated terms. If you do not agree with the modified terms, you must stop using our services. DESCRIPTION OF SERVICES Healing Health Physiotherapy provides physiotherapy and rehabilitation services for patients with various musculoskeletal, neurological, and other conditions. Our services include but are not limited to: initial consultation and assessment with Dr. Sagar Sahu or qualified physiotherapists, physical examination and diagnostic procedures, treatment planning and personalized therapy protocols, manual therapy and hands-on treatment, therapeutic exercises and rehabilitation programs, postoperative rehabilitation and recovery support, pain management and relief techniques, posture correction and body mechanics training, pediatric physiotherapy for children, neurological rehabilitation for stroke and paralysis patients, modern equipment-based treatment, progress monitoring and documentation, home exercise programs and guidance, and follow-up consultations and maintenance sessions. Our services are provided by qualified physiotherapists registered with the Indian Association of Physiotherapists or equivalent regulatory bodies. We do not provide services outside the scope of physiotherapy and rehabilitation. Any advice or recommendations are within the context of physiotherapy care only and should not replace medical consultation with a doctor. ELIGIBILITY AND PATIENT REQUIREMENTS To use our services, you must: be at least 18 years of age (or have parental/guardian consent if younger), have a genuine medical or health-related need for physiotherapy services, be willing to cooperate with our treatment protocols and exercise programs, be able to provide accurate medical and health information, and be committed to attending scheduled appointments and following medical advice. You are responsible for providing accurate, complete, and truthful information about your medical history, current symptoms, medications, allergies, and any other relevant health information. Providing false or misleading information may compromise your treatment and could result in injury or complications. You must disclose any contraindications or conditions that might affect your treatment. If you have serious health conditions, heart problems, recent surgery, pregnancy, or other significant medical issues, you should consult with your primary physician before starting physiotherapy at our clinic. APPOINTMENT BOOKING AND SCHEDULING Appointments can be booked through our WhatsApp (+91 8815021718), phone (+91 8519010967 or +91 8120276045), website, or in-person at the clinic. We operate on a first-come-first-serve basis for appointment slots. Availability is limited and appointments should be booked in advance. We will send you confirmation via WhatsApp or SMS upon successful booking. You are responsible for confirming your appointment details. If any information is incorrect, please notify us immediately at support@healinghealthphysio.in or by calling +91 8519010967. Clinic Hours: Monday to Saturday, Morning: 9:00 AM to 1:00 PM, Evening: 4:00 PM to 8:00 PM. Sunday: Closed. Appointments are scheduled for specific time slots. Arriving more than 15 minutes late may result in cancellation of your appointment. We reserve the right to reschedule late arrivals based on clinic capacity. Please arrive 10 minutes early to complete any necessary forms or documentation. CANCELLATION AND RESCHEDULING POLICY Cancellations must be made at least 24 hours in advance by contacting us via WhatsApp, phone, or email (support@healinghealthphysio.in). Cancellations made less than 24 hours before the appointment may incur a cancellation fee as per our pricing structure. No-shows without prior notification may result in charges and loss of appointment slot priority. Rescheduling can be done without penalty if requested at least 48 hours in advance, subject to slot availability. Repeated no-shows or cancellations may result in suspension of appointment booking privileges at our clinic's discretion. Extraordinary circumstances (illness, emergency) may be considered for waiver of cancellation fees upon presentation of evidence and at clinic management's discretion. PAYMENT TERMS AND BILLING Our services are provided on a fee-for-service basis. Consultation fees, treatment costs, and package prices are displayed on our website and communicated during booking. You are responsible for paying all charges incurred for services received. Payment can be made in cash at the clinic, through bank transfer, digital payment methods (UPI, Google Pay, PhonePe), or credit/debit card, as available. Payment is due at the time of service unless a payment plan or package has been arranged in advance. All package deals and discounts are non-transferable and valid only for the patient who purchased them. Packages are valid for the period specified at the time of purchase. If a package expires, unused sessions will be forfeited unless otherwise agreed in writing. Refunds are generally not provided for completed sessions. For unused services in packages, refund requests must be submitted within 30 days of package expiration. Refunds, if approved, will be processed within 7-10 business days minus any sessions already attended. No refunds are provided for sessions cancelled within 24 hours of appointment. We reserve the right to revise our pricing and treatment costs at any time. Existing patients will be notified of price changes 30 days in advance. If you have financial difficulties or require a payment plan, please contact us at support@healinghealthphysio.in to discuss available options. Late payment may result in suspension of future appointments until outstanding amounts are settled. PATIENT RESPONSIBILITIES You are responsible for: attending all scheduled appointments punctually, arriving on time for your sessions, following all instructions provided by our physiotherapists regarding exercises and treatment protocols, informing us of any changes in your medical condition or symptoms, reporting any adverse reactions or complications during treatment immediately, following post-treatment guidelines and home exercise programs as prescribed, maintaining open communication with our staff about your progress and concerns, and providing updated medical information if your health status changes significantly. You agree to cooperate fully with our clinical staff and follow their professional recommendations. Failure to cooperate or follow treatment protocols may reduce the effectiveness of your treatment and could result in delayed recovery. You are responsible for your own safety and should inform staff immediately of any pain, discomfort, or unusual symptoms during or after treatment. You must respect the clinic's environment and property and not damage or misuse any equipment or facilities. MEDICAL DISCLAIMER Our services are provided for informational and therapeutic purposes only and do not constitute medical advice, diagnosis, treatment, or cure for any medical condition. Physiotherapy is a healthcare profession but is not a substitute for medical evaluation by a physician. You should always consult with your primary care physician or medical specialist for diagnosis, treatment decisions, or serious health concerns. While our physiotherapists are qualified professionals, treatment outcomes vary based on individual factors including age, overall health, compliance, and nature of condition. We make no guarantees regarding specific treatment results or recovery timelines. Some conditions may not be suitable for physiotherapy alone and may require concurrent medical treatment or surgical intervention. If you experience severe pain, unexplained symptoms, or signs of serious medical conditions, seek immediate medical attention at a hospital or with your doctor rather than relying solely on physiotherapy. Our physiotherapists are not doctors and cannot prescribe medications, order medical tests, or provide surgical recommendations. Any medical concerns should be addressed with your physician. We are not liable for any medical conditions that worsen due to reasons outside our control or for conditions not appropriately managed through physiotherapy alone. If you are taking medications or have serious medical conditions, discuss your physiotherapy with your prescribing physician to ensure compatibility. LIMITATION OF LIABILITY To the fullest extent permitted by law, Healing Health Physiotherapy shall not be liable for: any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, loss of profits or revenue, loss of business opportunity, loss of data, emotional distress, or any other damages not directly foreseeable from our actions, injuries or complications arising from your failure to follow instructions or disclose medical information, pre-existing conditions that worsen during or after treatment, or any services provided by third parties or other healthcare providers. Our total liability for any claim arising from these Terms and Conditions shall not exceed the amount you paid for the specific service that caused the claim. This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitations on liability, so this limitation may not apply to you. We are not liable for any service interruptions, website downtime, WhatsApp connectivity issues, or delays in communication that are beyond our reasonable control. ASSUMPTION OF RISK AND MEDICAL ACKNOWLEDGMENT You acknowledge that physiotherapy treatment involves certain risks, including temporary increases in pain or discomfort, muscle soreness, swelling, bruising, and in rare cases, more serious injury. You assume all risks associated with receiving physiotherapy services. You confirm that you have discussed these risks with our physiotherapists before beginning treatment and understand them. You are responsible for monitoring your body's response to treatment and immediately reporting any adverse reactions. If you experience unusual or severe reactions, discontinue the treatment and contact our clinic immediately or seek emergency medical care if necessary. You acknowledge that you have read and understood this Medical Disclaimer and the inherent risks of physiotherapy treatment. You confirm that you have not been promised any specific outcome or cure. You agree that you have either obtained medical clearance from your physician or accept full responsibility for any medical consequences of pursuing physiotherapy without such clearance. You accept that recovery is gradual and results depend on multiple factors including your commitment to exercise, adherence to instructions, and individual healing capacity. CONFIDENTIALITY AND PRIVACY We maintain strict confidentiality of all patient information in accordance with our Privacy Policy and applicable healthcare laws. Your medical records, personal information, and details of your treatment are confidential and will not be shared with third parties without your explicit written consent, except as required by law. We may use anonymized case information for educational or research purposes without identifying you. You consent to our use of WhatsApp for appointment reminders, treatment updates, and follow-up messages. WhatsApp messages are subject to WhatsApp's privacy practices in addition to our own. For sensitive medical discussions, you may request communication through other channels by contacting support@healinghealthphysio.in. INTELLECTUAL PROPERTY RIGHTS All content on our website, including text, images, videos, exercise programs, treatment protocols, logos, and designs are the exclusive property of Healing Health Physiotherapy or are used with permission. You may not reproduce, distribute, transmit, modify, or use any content from our website or services without prior written permission from us. Unauthorized use of our intellectual property violates copyright, trademark, and other intellectual property laws. If you create content (such as testimonials or reviews), you grant us the right to use such content for marketing purposes. TESTIMONIALS AND REVIEWS Any testimonials, success stories, or reviews on our website or marketing materials are genuine but represent individual results and experiences. Upon termination, your outstanding medical records will be transferred to another healthcare provider upon request and with appropriate authorization. You will be responsible for any outstanding payment obligations. WEBSITE AND DIGITAL PLATFORMS Access to our website is provided on an "as-is" and "as-available" basis. We make no warranties regarding website functionality, accuracy of information, or uninterrupted access. We are not responsible for website errors, technical glitches, or temporary service interruptions. SEVERABILITY If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect. This severability clause ensures that the invalidity of one provision does not invalidate the entire agreement. WAIVER The failure of Healing Health Physiotherapy to enforce any right or provision of these Terms and Conditions does not constitute a waiver of that right or provision. If we waive any provision in one instance, such waiver does not constitute a continuing waiver of that provision or a waiver of any other provision. Any waiver must be in writing and signed by our authorized representative to be valid. ENTIRE AGREEMENT These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Healing Health Physiotherapy regarding your use of our services and supersede all prior negotiations, understandings, and agreements, whether written or oral. No representations, warranties, or agreements have been made except as expressly stated in these terms.
